”ＭＡＮＧＡ”商標登録の件の続報です。
やはり懸念していた通り、Manga Entertainment Limitedの商標登録
の内容にはロゴだけでなく、そのパーツ、すなわち「ＭＡＮＧＡ」と
漢字（！）の「漫画」が含まれていることがHelen McCarthyさんの調
査で明らかになりました。これはイギリスの商標登録局の審査官であ
るStuart Willmottさんによって確認されたもので信憑性が非常に高い
情報です。コミック・マーケットとしてどのような対応を取るか協議
中ですが、とりあえず手紙の内容をアップします。従来通り原文と同
時にという条件で転載自由です。

MANGA VIDEO TRADEMARK APPLICATION

I thought I would bring you up to date on the latest developments
in this matter.
About ten days ago I was informed that Mr. Andy Frain of Manga
Entertainment had gone on Internet (via an anonymous address)
with a statement that said his company was not going to trademark
the word "manga" but just their logo, and also saying a number
of other things.
Since I had not then seen a copy of the statement I was unable to
respond in full, but I asked a friend to put a message an Internet
from me, saying that if Manga Entertainment only wanted to tradermark
their logo I had no objection, and commenting on some of the issues
raised. I also wrote to the Patent Office stating that providing
Manga Entertainment only wished to resister their logo, and not the
word MANGA, I would withdraw my objection.
I eventually receive a copy of Mr. Frain's statement from a friend at
the end of last week (Thursday 21st June). It seemed to me that there
were a number of ambiguities contained in the text and so I telephoned
the Patent Office Trade Mark Resistry this morning and spoke to Mr.
Stuart Willmott.
He told me that as the application stands - that is as it was
originally made by Manga Entertainment - the application for a trade
mark is BOTH for the logo AND for the individual component parts of
the logo. In other words, if their application is granted, Manga
Entertainment will in fact be able to claim as their exclusive trademark
not just their logo but also the word MANGA (in both Roman lettering
and kanji!) and the other individual components. The trademark would
be valid for a wide range of goods such as electronic media (including
both computer games and their programmes in published form), publifications
such as books and magazines, films and videos, clothing and so on.
I think I am therefore justified in saying that insofar as it is humanly
possible I have carefully checked my information with the proper sources
and I have been neither lying nor misleading people about this application.
Manga Entertainment HAVE applied to trademark the word MANGA as well as
their logo, both in Englishe and in Japanese, and this is not just my
own opinion but also the view of the Trade Marks Registry.
I was also told this morning that objections to this application have
come in from all over the world - from Japan, the USA, Portugal,
Barbados and Australia among other countries. I am very encouraged
to know that so many foreign fanscare about what happens in the UK.
However, Manga Entertainment Limited have applied for these trademarks
in a number of different countries. The sensible course of action,
for any individual or company who is concerned with doing business
or with fan activity in a particular country, isa to contact the
Trade Marks Registry of that country to ascertain the precise
local stituation.
I would be very grateful if you could translate the whole of this
message and put it onto the Japanese networks.

上記の件につき近況報告をさせて頂きます。
約１０日ほど前、私はマンガ・エンタテイメントのアンディフレイン氏がイン
ターネットのanonymous adress（不特定向け回線）経由で彼の会社は「ｍａｎ
ｇａ」という用語を登録しようとしているのではなく、単にロゴのみを登録し
ようとしているのだというステートメントをほかの多くのことがらとともに発
表したと聞きました。
その時私はステートメントのコピーを見ていなかったため、全てについて答え
ることができませんでしたが、私からのメッセージとして、もしマンガ・エン
タテイメントが単にロゴのみを商標登録しようとしているのであれば反対する
つもりはなく、またその他の事柄に対する返答も併せてインターネットに掲載
してくれるように友人に頼みました。また商標登録局に対しもし言われる通り
マンガ・エンタテイメントがロゴのみの登録を希望しているのであれば、反対
を取り下げる旨の手紙を書きました。
そして私はついに先週の週末（６月２１日）にフレイン氏の声明を友人から入
手しました。私にはその内容に不明な点が多く含まれていると感じましたので
今朝商標登録局に電話しスチュワート・ウイルモット氏と話しました。
彼は私に、申請は － すなわちマンガ・エンタテイメントによってなされた
もの － は、ロゴおよびその構成するパーツ両方であると語りました。つま
り、もし彼らの申請が受理されると、マンガ・エンタテイメントは実際にロゴ
だけでなく、他のロゴのパーツとともに（ローマ字および漢字！）による「漫
画」という言葉に対して独占使用権を主張できることになるのです！商標権の
及ぶ範囲は広く、電子メディア（コンピュータ・ゲームや印刷形態によるそれ
らのプログラム）、雑誌や本、フィルムやビデオ、衣服などに及ぶことになり
ます。
つまり私は出来得るかぎり正しい情報源から得た情報を注意深く解釈すること
によってこの件に関し嘘をついたりわざと人々を誤った方向へ導こうとしてい
るのではないことを解っていただけると思います。マンガ・エンタテイメント
はＭＡＮＧＡという言葉およびロゴ両方を、英語および日本語で登録しようと
したのであり、これは私個人の意見ではなく、商標登録局の見解なのです。
私は今朝またこの申請に対する反対が世界中からー日本、アメリカ合衆国、ポ
ルトガル、バルバドス共和国、オーストラリアその他の国々から寄せられてい
ると聞きました。私は現在英国で起こっていることに対しこんなに多くの外国
のファンが関心を持ってくれていることにたいへん励まされています。しかし
ながらマンガ・エンタテイメント・リミテッドはいくつもの国で申請を行って
います。当然のこととしてこれらの国の方々や関係する会社の方々、ファン活
動をされておられる方々にはそれぞれの国における正確な状況を商標登録局に
確認されるのが良いと思います。
